These Terms and Conditions ("Terms") govern the use of the GameofYY subscription gaming service ("Service") offered to customers of Telkom SA SOC Limited in South Africa.
By subscribing to, accessing or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms.
For purposes of these Terms:
3.1 By completing the applicable subscription journey and confirming your subscription, you expressly authorise the applicable billing mechanism to charge the Subscription Fee.
3.2 The Subscription Fee is:
Daily subscription of R7.00 per day, inclusive of VAT.
3.3 The Subscription is a daily recurring subscription and the Subscription Fee will recur automatically each day until the Subscription is cancelled.
3.4 The applicable price and recurring nature of the Subscription will be clearly communicated to you during the subscription process before confirmation.
3.5 Depending on the applicable subscription journey, billing may be processed through the Operator's approved billing mechanism, including deduction from available prepaid airtime, mobile account balance or other supported billing method.
3.6 A confirmation and/or welcome message may be sent following successful subscription.
3.7 Where there are insufficient funds or airtime to process a daily renewal, the applicable billing mechanism may retry the charge in accordance with the Operator's applicable billing rules.
3.8 Standard mobile data charges may apply when accessing the Service. Such data charges are separate from the Subscription Fee and are determined by the applicable mobile network provider.
3.9 Subscribing to the Service does not guarantee unlimited mobile data or internet access.
4.1 From time to time, the Provider and/or Operator may offer a free trial or promotional subscription.
4.2 Where a free trial is offered, the duration and applicable conditions will be communicated at the time of subscription.
4.3 Unless otherwise stated, a free trial may convert automatically into the paid daily Subscription at R7.00 per day, inclusive of VAT, after the trial period ends.
4.4 You may cancel before the end of the applicable free trial to prevent the paid Subscription from commencing.
4.5 Promotional offers may be subject to additional terms and conditions.
You may subscribe to GameofYY through one or more approved channels, which may include:
A confirmation SMS or other electronic confirmation may be provided following successful subscription.
6.1 You may cancel your GameofYY Subscription at any time.
6.2 Cancellation may be performed through one or more of the following methods, depending on the applicable subscription journey:
6.3 Once cancellation has been successfully processed, no further recurring Subscription Fees will be charged.
6.4 Cancellation does not ordinarily entitle you to a refund of a Subscription Fee already validly charged for a period in which the Service was available, except where a refund is required by applicable law or otherwise determined to be appropriate following investigation of a billing dispute.
6.5 If you experience difficulty cancelling the Service, you should contact the applicable customer support channel for assistance.
7.1 Following successful subscription, you may access GameofYY gaming content during the period for which your Subscription remains active.
7.2 Access to the Service requires a compatible device and an active internet or mobile data connection unless particular content is expressly made available offline.
7.3 The range of games, content and features available through GameofYY may change from time to time.
7.4 Certain games or content may be subject to additional terms, age restrictions or conditions imposed by the relevant game publisher or content owner.
7.5 The Provider does not guarantee that every game or item of content will remain available for the duration of your Subscription.
8.1 GameofYY may include games, content, software, services or links supplied by third-party developers, publishers or content providers.
8.2 Third-party games and content may be subject to separate terms, privacy policies, age restrictions and usage requirements.
8.3 The Provider does not necessarily own all games or third-party content made available through the Service.
8.4 Where applicable, additional purchases, subscriptions, virtual items or other charges offered by a third party are separate from the GameofYY Subscription and may be subject to additional terms.
8.5 Users are responsible for reviewing any applicable third-party terms before making additional purchases or using third-party services.

The Provider may suspend or terminate access where it reasonably believes that a User has engaged in prohibited or fraudulent activity.
10.1 From time to time, GameofYY may offer competitions, tournaments, challenges, leaderboards, rewards or promotional campaigns.
10.2 Participation in a particular promotion may be subject to additional competition or promotional terms and conditions.
10.3 Additional eligibility requirements may apply to specific competitions or tournaments.
10.4 The Provider reserves the right to verify participant eligibility and the validity of results.
10.5 The Provider may disqualify a participant where there is reasonable evidence of cheating, fraud, manipulation, abuse or a breach of applicable promotional rules.
10.6 Prizes and rewards are subject to the specific terms applicable to the relevant promotion.
11.1 All intellectual property associated with GameofYY, including trademarks, logos, software, platform technology, graphics, text, designs and original content, remains the property of the Provider or its respective licensors.
11.2 Games and third-party content remain the intellectual property of their respective owners.
11.3 Your Subscription grants you a limited, personal, non-exclusive and non-transferable right to access and use the Service for its intended purpose during an active Subscription.
11.4 No ownership or other intellectual property rights are transferred to you through your Subscription.
12.1 The Service is provided on an “as available” and “as is” basis, subject to applicable law.
12.2 The Provider does not guarantee that the Service will always be uninterrupted, available or error-free.
12.3 Access may be temporarily interrupted due to maintenance, upgrades, technical faults, network failures, device incompatibility, third-party services or circumstances beyond the Provider's reasonable control.
12.4 The Provider may modify, suspend or discontinue particular games, content or features from time to time.
13.1 GameofYY is provided primarily for entertainment and gaming purposes.
13.2 The Provider does not guarantee that the Service or any particular game will meet your individual expectations or preferences.
13.3 Game performance may vary depending on the User's device, operating system, internet connection, network conditions and other technical factors.
13.4 GameofYY may contain third-party content, advertisements, links or services. The Provider does not necessarily endorse or control third-party content.
13.5 Nothing in these Terms excludes any rights or protections that cannot lawfully be excluded under South African law.
14.1 To the maximum extent permitted by applicable South African law, the Provider and Operator will not be responsible for losses arising from:

15.1 Subscription charges that have been validly incurred following a confirmed subscription are generally not refundable solely because the User did not access or use the Service, subject always to applicable law.
15.2 If you believe that you have been incorrectly charged, you should raise the dispute as soon as reasonably possible through the applicable Operator customer care or designated GameofYY support channel.
15.3 Billing disputes may be investigated against the applicable subscription and billing records.
15.4 Where an incorrect charge is confirmed, any applicable refund or adjustment will be handled in accordance with the Operator's and/or Provider's applicable refund processes and South African law.

20.1 The Provider may update, modify or improve the Service from time to time.
20.2 These Terms may be amended where reasonably necessary, subject to applicable law and any required notification.
20.3 Updated Terms may be published on the Service website or otherwise communicated to Users where required.
20.4 If a material change requires User notification or consent under applicable law or regulatory requirements, the appropriate notification or consent process will be followed.
21.1 The Provider and/or Operator may suspend or terminate access to the Service where reasonably necessary, including where:

The Provider and/or Operator will not be responsible for failure or delay in performing obligations where such failure or delay results from circumstances beyond reasonable control, including network failures, telecommunications outages, natural disasters, acts of government, civil unrest, cyber incidents, power failures or other force majeure events.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed or limited to the extent necessary, and the remaining provisions will continue in full force and effect.
Failure by the Provider or Operator to enforce any provision of these Terms will not constitute a waiver of that provision or any other right.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
Any dispute will be subject to the applicable dispute-resolution mechanisms and jurisdiction provided for under South African law.
These Terms, together with any applicable promotional terms, competition rules, privacy notices and other terms expressly incorporated by reference, constitute the agreement between the User and the Provider in relation to the Service.
Where there is a conflict between these Terms and mandatory provisions of applicable law, the mandatory provisions of applicable law will prevail.
